1. Introductory Provisions

We.Be.Capital (hereinafter the “Company”), trading under the brand NP Fitness, is the exclusive owner and administrator of the website www.npfitness.gr (“Website”). All services and transactions provided through the Website are conducted by the Company, which bears full legal responsibility.

The Company, adopting an interdisciplinary approach combining sports science, behavioral psychology, and technological innovation, offers specialized online fitness and wellness programs.

Accessing, browsing, or conducting a financial transaction on the Website constitutes conclusive evidence that the visitor/user (“User” or “Member”) fully accepts these Terms. If the User disagrees, they must refrain from any use of the services.

The Company reserves the right to unilaterally amend these Terms, with such amendments taking effect upon their publication on the Website.

2. Definitions

  • Member: A natural person over 18 years of age who completes a financial transaction and acquires subscription access.

  • Subscription: A time-limited, non-transferable right to use specific services and/or content.

  • Coaching Service: Online guidance in fitness & wellness provided through email, video conferencing, or other digital channels.

  • Digital Product: Electronic files (e.g., e-books, PDF guides, workout programs) made available exclusively online.

3. Scope of Services

  • Digital Products: Scientifically substantiated educational material delivered via secure download links or cloud access.

  • Coaching Services: Advisory sessions on fitness and wellness, without in-person supervision or medical/dietetic diagnosis.

  • Exclusions: The Company does not provide physical goods, travel packages, medical services, or therapeutic dietetic acts.

4. Acceptance of Terms – Registration Procedure

Completion of an electronic form or payment constitutes a digital signature and establishes a service contract. Subscriptions are strictly personal and may not be transferred or assigned.

5. Financial Transactions

Transactions are processed through trusted third-party providers (Stripe, PayPal) or via bank transfer. The Company does not store card details; processing is subject to the security protocols of the providers.

6. Pricing Policy – Tax Compliance

All prices are in euros (€) and include VAT. Price adjustments are not applied retroactively to completed transactions.

7. Delivery of Digital Content

Provision is deemed completed upon successful dispatch of an email containing the download link or granting access to cloud storage.

8. Withdrawal – Refunds

Due to the intangible nature of digital goods and pursuant to Article 3(12b) of Law 2251/1994, the User waives the right of withdrawal. Refunds or cancellations are not accepted once digital content has been delivered.

9. Personal Data Protection

Processors: Stripe, PayPal, and other contracted providers.

  • Data Collected: Full name, email, purchase history, program selections (never sensitive health data).

  • Purposes: Contract performance, invoicing, communication, marketing (with consent).

  • Rights: Access, rectification, erasure, restriction, portability, objection. Requests via email: we.be.capital.lp@gmail.com.

  • Complaints: Users may lodge complaints with the Hellenic Data Protection Authority (www.dpa.gr).

  • Security: SSL encryption, firewalls, hashed & salted passwords, breach notifications within 72 hours (GDPR Articles 33–34).

10. Cookies

The Website uses:

  • Functional cookies.

  • Analytics cookies (Google Analytics, anonymized).

  • Advertising cookies (Facebook Pixel, only with consent).

Cookie use is disclosed via a cookie banner, where the User may accept or decline optional cookies.

11. Intellectual Property

All content is protected under Law 2121/1993 and international treaties. Any reproduction, modification, or commercial use is permitted only with prior written authorization from the Company.

12. Medical & Nutritional Disclaimer

The Company does not provide medical diagnosis, therapeutic acts, or individualized dietetic programs.

Any nutritional plans or sample guidelines provided are of a purely educational and informational nature and do not substitute for medical or dietetic advice.

The User acknowledges that:

  • They must consult a physician or licensed dietitian before making any dietary changes.

  • Implementation of any program is at their sole responsibility.

  • The Company assumes no liability for bodily or psychological harm, illness, or loss resulting from following suggested guidelines.

13. Limitation of Liability

  • Technical: The Company endeavors to ensure uninterrupted operation but cannot guarantee complete absence of errors or malware.

  • User Responsibility: The User bears sole responsibility for applying the guidance; Company liability is limited to the transaction amount paid.

  • Bodily Injury: The Company disclaims liability for injury or death resulting from improper use of instructions.

14. Security

The Company applies SSL certificates, firewalls, and encrypted password storage. In case of a data breach, notifications will be issued within 72 hours in line with GDPR obligations.

15. Third-Party Links

The Website may contain links for user convenience. The Company bears no responsibility for the content or privacy practices of third-party websites.

16. Amendments

Any amendments are effective upon posting on the Website and bind the User through continued use.

17. Governing Law – Jurisdiction

These Terms are governed by Greek law. The Courts of Lamia shall have exclusive jurisdiction.
